We prepare customized Texas postnuptial agreements, also called postmarital property agreements, for married couples who want to clarify or restructure their property rights during marriage

 

A postnuptial agreement is the broad category. Depending on your goals, the agreement may include:

• Clarify ownership of assets

• Divide community property 

• Convert community property to separate property (i.e., A "partition or exchange agreement")

• Convert separate property into community property

• An agreement concerning income from separate property

• Protect Future Earnings/Shield from Liability

• A separation-style agreement for spouses who intend to remain married but live separately

📄 Review of Postmarital Agreements Drafted by Another Attorney

 

We also represent clients who have been presented with a postmarital agreement drafted by their spouse or their spouse’s attorney. Our services focus on protecting your interests, identifying problematic provisions, and ensuring the agreement is fair, enforceable, and consistent with Texas law.

📝Separation Agreement — Starting at $3,500

 

Texas does not have a formal “legal separation” status. However, spouses who intend to remain married may enter into certain agreements concerning property, debts, support, taxes, insurance, and financial responsibilities while living separately.

​

Because separation agreements vary widely in scope, the fee is determined after consultation.

​

This service does not include:

​

• Divorce filings

• Court appearances

• Contested litigation

• Child custody

• Child possession or access

• Child support

• A suit affecting the parent-child relationship

​

Those matters require a separate scope of representation.​​

🔧 Complex or Hybrid Postnuptial Agreements — Generally $3,000–$4,500+

​

Some postnuptial agreements require a custom scope and fee because they involve more complicated property, debt, business, tax, estate-planning, or implementation issues.

 

This category may apply when the agreement involves more than ordinary drafting, such as:

​

• Multiple properties or business interests

• Substantial existing community property

• Mixed or disputed property character

• Tracing issues

• Broad future-income or future-acquisition provisions

• Creditor or liability concerns

• Foreign property

• Trusts or inheritance issues

• A combination of partition/exchange and conversion provisions

• Deeds, assignments, notes, liens, or other supporting documents

 

The final fee will be confirmed after review of the intake information and relevant documents.
